SKMS Terms of Service

Welcome to SKMS, a generative AI tool designed to enhance your understanding of video content. By accessing or using SKMS (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree with these Terms, please do not use our services.
1. Acceptance of Terms
By creating an account or using the SKMS services (“Service”), you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations, including the YouTube Terms of Service and the Google Privacy Policy.
2. Description of Service
SKMS provides:
- Video Chatbot: An AI-powered chatbot for specific searched videos to assist users in better understanding video content.
- Video Report Function: Generates a summary of video content through a combination of text and keyframes.
Our Service utilizes the YouTube Data API to search for and display videos based on user inputs, such as search queries, number of videos (1 to 5), and video duration preferences (short, medium, long). Videos are displayed within SKMS using an embedded iframe, allowing users to play and interact with the content.
3. Account Registration
3.1. Eligibility
To use SKMS, you must be at least 13 years old. By registering for an account, you represent and warrant that you meet this age requirement.
3.2. Account Creation
Users can create an account by:
- Email Registration: Providing a valid email address and creating a password.
- Google Sign-In: Logging in with your Google account. When using Google Sign-In, only your Gmail address will be used to create a SKMS account.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. User Responsibilities
By using our Service, you agree to:
- Provide accurate and complete information during registration.
- Use the Service only for lawful purposes and in accordance with these Terms.
- Not engage in any activity that could harm or disrupt the Service or other users.
- Comply with all applicable laws, regulations, and third-party rights.
5. Use of the Service
5.1. Search and Interaction
- Users can search for desired videos using keywords and filters such as the number of videos and video duration.
- The Service will display search results, allowing users to play videos and interact with the AI chatbot within SKMS.
5.2. Search History and Data Storage
- Search results and interactions are stored in your library (history) for up to 30 days in compliance with YouTube regulations.
- Video data is not stored beyond 30 days, and the library will only keep records from the recent 30 days.
5.3. Data Usage
- We collect and store user account information, search queries, and interaction data to provide and improve our services.
- We do not share your personal information with external parties except as outlined in our Privacy Policy.
6. User Content and Conduct
- You may not upload, post, or transmit any content that infringes upon the rights of others or violates any laws.
- You are solely responsible for any content you provide and for your interactions with the Service.
- We reserve the right to remove content or terminate accounts that violate these Terms.
7. Third-Party Services and Content
- SKMS may display third-party content, including videos and advertisements, as part of the video playback feature.
- We are not responsible for third-party content, and your use of such content is at your own risk.
- Use of the YouTube Data API is subject to the YouTube Terms of Service.
8. Privacy Policy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and safeguard your information.
9. Data Handling and Storage
9.1. Authorization and Data Access
- Users authorize access to their data through Google’s OAuth 2.0 system.
- Our application requests only the necessary scopes for its functionality.
- Authorization tokens are stored securely and are refreshed regularly.
9.2. Data Retention
- Authorization tokens are stored as long as necessary for active users.
- YouTube Analytics API and Reporting API data may be stored longer than 30 days.
- Other authorized data is stored for no longer than 30 calendar days.
- Non-authorized data is also stored for no longer than 30 calendar days.
9.3. Data Accuracy and Deletion
- We regularly refresh stored data to ensure accuracy.
- Data that is no longer authorized or needed is deleted promptly.
10. Data Access Revocation
10.1. Revocation Process
Users can revoke SKMS’s access to their data at any time:

10.2. Post-Revocation Actions
- Upon revocation, we will immediately revoke the API token.
- All associated authorized data will be deleted within 7 calendar days.
11. User Privacy and Data Deletion
- Users can request deletion of their stored data at any time through our application.
- Upon such a request, we will delete the user’s data as soon as possible and within 7 calendar days.
12. Security Measures
We implement industry-standard security measures to protect user data, including:
- Administrative, organizational, technical, and physical controls.
- Industry-standard transport encryption.
- Measures to prevent unauthorized access, use, or disclosure of API data.
13. Compliance with YouTube Policies
- We comply with all YouTube API Services policies, including those related to data handling, user consent, and appropriate use of API services.
- We do not engage in scraping or unauthorized data collection from YouTube.
- We only display authorized data to the user who granted access.
- We clearly identify any actions taken on a user’s behalf and require explicit consent.
- We do not aggregate data across different content owners.
- We do not use API data to create derived metrics or replace YouTube’s data with our own calculations.
14. Modifications to the Terms
We reserve the right to modify these Terms at any time. If we make changes, we will:
- Provide reasonable advance notice through our website or by other means.
- Update the “Effective Date” at the top of these Terms.
Your continued use of SKMS after changes to the Terms constitutes acceptance of the modified terms. If you do not agree to any changes, you should discontinue using the Service.
15. Termination
We may suspend or terminate your access to SKMS at any time for any reason, including:
- Violation of these Terms.
- Compliance with legal requirements.
- Discontinuation or material modification of the Service.
Upon termination, your right to use the Service will immediately cease.
16. Disclaimers
- The Service is provided on an “as is” and “as available” basis without warranties of any kind.
- We do not guarantee the accuracy, completeness, or usefulness of any information on the Service.
- We are not liable for any loss or damage resulting from your use of the Service.
17. Limitation of Liability
To the fullest extent permitted by law:
- SKMS, its affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
- Our total liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the amount you have paid us for the use of the Service.
18. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of HKSAR, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in HKSAR.
